ACCIDENT WAIVER, RELEASE OF LIABILITY AND INDEMNITY/HOLD HARMLESS AGREEMENT

I represent to Fathers On A Mission, Inc. that I am physically fit, and that I am not aware of any physical or mental restrictions that would prevent me from safely participating in Fathers On A Mission, Inc. activities.

I acknowledge that these activities are potentially dangerous and involve the risk of injury, death, or property damage.

I acknowledge that this Accident Waiver and Release of Liability form will be used by Fathers On A Mission, Inc. event holders, sponsors, and organizers and that it will govern my actions and responsibilities at the Fathers On A Mission, Inc. activities.

In consideration of my participation in Fathers On A Mission, Inc. activities, I hereby take action for myself, my executor personal representative, administrators, heirs, next of kin, successors and assigns to: (A) Waive, Release, and Discharge from any and all liability from my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter accrue to me, including as to my traveling to and from these activities, the following entitles or persons: Fathers On A Mission, Inc., it’s Board Members, Officers, Committee Members, volunteers, and others working or acting in behalf of Fathers On A Mission, Inc.; and to the extent permitted by law (B) Indemnify and Hold Harmless the entities as a result of or relating to my attendance at or my participation in Fathers On A Mission, Inc. activities.

In consideration of participation Fathers On A Mission, Inc., I agree that my likeness may be photographed or videotaped and that such images may be published in an outlet used to promote an activity.

Fathers On A Mission, Inc. has put in place preventative measures to reduce the spread of COVID-19; however, Fathers On A Mission, Inc. cannot guarantee that you or your child(ren) will not become infected with COVID-19 or other infectious diseases including, but not limited to MSRA and influenza.

By purchasing a ticket, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending “GEMS and GYM SHOES”- A DADDY DAUGHTER SNEAKER BALL and the such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to infected by COVID-19 at the Event may result from the actions, omissions, or negligence of myself and others, including, but not limited to Fathers On A Mission, Inc. Board members, Officers, Committee members, volunteers, and participants and their families.

I VOLUNTARILY AGREE TO ASSUME ALL SUCH RISKS and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to , personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with child(ren)’s attendance at the Event or participation in Fathers On A Mission, Inc. programming (“Claims”). On my behalf, and on the behalf of my child(ren), I hereby release, covenant not to sue, discharge, and hold harmless Fathers On A Mission, Inc., its Board members, Committee members, Officers, volunteers, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs of expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Fathers On A Mission, Inc., its Board members, Officers, Committee members, volunteers, and representatives, whether a COVID-19 infection occurs before, during, or after participation in the “GEMS and GYM SHOES”: A DADDY DAUGHTER SNEAKER BALL event.
